By accessing, browsing, or using mstrjk.com (the "Site," "Service," or "Platform"), you ("User," "you," or "your") acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service ("Terms," "Agreement"), our Privacy Policy, and our Cookies Policy (collectively, the "Agreements"). These Terms constitute a binding legal agreement between you and MSTRJK Entertainment Group, Co. ("Company," "we," "us," or "our"), a company organized under the laws of the State of Texas.

IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST IMMEDIATELY CEASE ALL USE OF THE SITE. Your continued use of the Site constitutes acceptance of these Terms as they may be modified from time to time.

1. Eligibility & Account Registration

Age Requirements: You must be at least 13 years of age to create an account or use the Site. If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you represent that you have obtained the consent of your parent or legal guardian to use the Site and that they have read and agreed to these Terms on your behalf.

Content Warning: The Site is recommended for users 16 years of age and older. Content may include mature themes, explicit language, adult subject matter, and other content not suitable for children. By using the Site, you acknowledge and accept that you may encounter such content.

Account Security: You are responsible for maintaining the confidentiality of your account credentials (username and password) and for all activities that occur under your account. You agree to immediately notify us at help@mstrjk.com of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to protect your account credentials.

Accurate Information: You agree to provide accurate, current, and complete information during registration and to update such information to maintain its accuracy. Providing false or misleading information may result in immediate termination of your account.

2. Supplemental Terms

Specific features of the Site, such as the integrated music player and the digital store, are governed by separate, supplemental legal agreements. You will be required to read and accept these supplemental terms ("Supplemental Terms") before you can access or use those specific features.

3. Privacy, Cookies & Do-Not-Sell/Share

We publish detailed Privacy and Cookies Policies that explain exactly what we collect, how long we keep it, and how to exercise rights under GDPR, CPRA/CCPA, CPA, TDPSA, and similar laws. The footer provides a "Do Not Sell/Share My Personal Info" control that immediately disables all non-essential cookies and tracking; you may also email privacy@mstrjk.com to confirm an opt-out.

4. Account Ownership & Deletion

You are responsible for keeping your account credentials secure. Logged in users can request permanent account deletion from the Profile page. Once confirmed, deletion is immediate and irreversible. If you need help, contact help@mstrjk.com. We permanently erase the account and associated personal data upon confirmation.

5. Intellectual Property Rights (License to View)

All content on this Site—including but not limited to music, lyrics, audio, video, text, graphics, logos, images, artwork, branding, and software code (collectively, "Content")—is the exclusive property of MSTRJK Entertainment Group, Co. and is protected by U.S. and international intellectual property laws.

We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for your personal, non-commercial use only. This license is strictly limited to viewing, reading, and interacting with the Site's public-facing content as intended and does not grant you any rights to copy, download, reproduce, modify, distribute, or create derivative works from the Content.

6. Prohibited Conduct & Anti-Abuse Policy

You are expressly prohibited from:

  • Any form of hacking, "denial-of-service" (DDoS) attack, or attempting to overload the Site's servers.
  • Using any bot, scraper, spider, or other automated means to access, copy, or data-mine the Site's Content or code.
  • Attempting to reverse-engineer, decompile, alter, or modify the Site's client-side or server-side code.
  • Impersonating Company staff, artists, or other users.

Any attempt to interfere with or disrupt the Site's code, servers, or security will be deemed an intentional act of abuse. We reserve the right to collect all available user data (including IP address) to enforce a permanent IP blacklist and, if necessary, provide such data to law enforcement.

7. Commenting System

The website provides two distinct methods for user participation. The terms governing data retention, deletion, and privacy differ significantly depending on which method you choose:

1. Commenting Modes

A. Authenticated Commenting (Logged In)

  • Identity: Comments are publicly linked to your registered user profile.
  • Data Association: Activity is tied to your email and account history.
  • Management: You may edit or delete your comments at any time via your account dashboard.
  • GDPR/Privacy: Comments made while logged in are considered "Personal Data." You retain full rights under GDPR (and similar privacy laws) to request the export or deletion of this data as part of your account management.

B. Anonymous Commenting (Logged Out)

  • Identity: Comments are published under an auto-generated, non-personal handle (e.g., "MightyShark57763414").
  • Data Association: Comments are not linked to a real name, email address, or registered profile.
  • Management: Limited to the specific browser and device used to post.
  • Permanence: Anonymous comments are considered permanent content if the local "ownership key" is lost.

2. Anonymous Commenting: Ownership & Deletion Limitations

Unlike authenticated users, anonymous users do not have a centralized dashboard. Ownership is verified solely through a temporary token stored locally in your browser.

  • Local Authority: You can only delete an anonymous comment if the original local data (cookies/local storage) remains on your device.
  • Loss of Rights: If you clear your browser cache, switch browsers, use Incognito/Private mode, or change devices, the link between you and the comment is broken.
  • Irreversible Action: Once this local link is broken, we are technically unable to verify you as the author. Consequently, the functionality to delete the comment is permanently lost.
  • Claiming on login: Signing in associates anonymous comments from this browser with your account display name.

3. Privacy & GDPR Distinctions

We take data privacy seriously. Please note how regulations apply differently to the two commenting models:

  • Authenticated Users: Your comments are treated as identifiable personal data. We will honor all "Right to Erasure" (RTBF) and "Subject Access Requests" regarding this content, as we can verify your identity via your login credentials.
  • Anonymous Users: Anonymous comments are designed to be decoupled from your personal identity.
  • Because we do not store personal identifiers (such as emails or names) linked to these comments, we cannot verify ownership of specific anonymous posts.
  • Therefore, we cannot fulfill GDPR erasure requests for specific anonymous comments once the local browser key is lost, as we have no means to confirm the requestor is the original author.
  • By choosing to comment anonymously, you consent to these limitations and acknowledge that your content may remain on the site indefinitely.

4. Moderation & Abuse Prevention

To maintain safety without requiring registration, we utilize technical identifiers for all users (both Authenticated and Anonymous).

  • Data Collected: We may process hashed IP addresses, browser user-agents, and session tokens to prevent spam, flooding, and abuse.
  • Enforcement: We reserve the right to filter, block, or remove any comment—regardless of authentication status—that violates our Community Guidelines.
  • Safety Deletion: While anonymous users cannot request deletion of their own content after losing their key, the Site Administrator reserves the right to remove anonymous comments that pose legal risks, contain hate speech, or threaten safety.

8. Disclaimers & No Warranty

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, THE COMPANY DISCLAIMS ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, MSTRJK ENTERTAINMENT GROUP, CO. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE SITE.

10. Indemnification

You agree to defend, indemnify, and hold harmless MSTRJK Entertainment Group, Co. and its officers and employees from and against any and all claims, damages, liabilities, and expenses (including attorneys' fees) arising from your breach of these Terms.

11. Governing Law, Jurisdiction & Dispute Resolution

Governing Law: These Terms and any disputes arising out of or relating to these Terms or your use of the Site shall be governed by and construed in accordance with the laws of the State of Texas, United States of America, without regard to its conflict of law principles.

Exclusive Jurisdiction: You agree that any legal action, suit, or proceeding arising out of or relating to these Terms or the Site must be brought exclusively in the federal or state courts located in Travis County, Texas. You hereby irrevocably consent to the personal jurisdiction and venue of such courts and waive any objection to such jurisdiction or venue.

Informal Dispute Resolution: Before filing any formal legal action, you agree to first contact us at help@mstrjk.com to attempt to resolve the dispute informally. We will make good faith efforts to resolve disputes amicably within 30 days of receiving notice.

Arbitration Agreement: At our sole discretion, we may elect to resolve disputes through binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules. The arbitration will be conducted in Travis County, Texas, and the arbitrator's decision will be final and binding. Each party will bear its own costs and fees unless otherwise awarded by the arbitrator.

Class Action Waiver: YOU AND THE COMPANY AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, REPRESENTATIVE, OR COLLECTIVE ACTION OR PROCEEDING. Unless both parties agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of representative or class proceeding.

Statute of Limitations: Any claim or cause of action arising out of or related to your use of the Site must be filed within one (1) year after such claim or cause of action arose, or be forever barred, regardless of any statute or law to the contrary.

12. Termination & Account Suspension

Termination by You: You may terminate your account at any time by using the account deletion feature in your Profile page. Deletion requests are placed in a 14-day grace period during which you may contact help@mstrjk.com to cancel the deletion. If not canceled, your account and associated personal data will be permanently deleted after 14 days.

Termination by Us: We reserve the right to suspend or terminate your account, or restrict your access to all or any part of the Site, at any time, with or without notice, for any reason or no reason, including but not limited to:

  • Violation of these Terms or any Supplemental Terms
  • Fraudulent, abusive, or illegal activity
  • Attempts to compromise Site security or integrity
  • Extended periods of account inactivity
  • Requests by law enforcement or government agencies
  • Unexpected technical issues or security vulnerabilities

Effect of Termination: Upon termination, your right to access and use the Site immediately ceases. Sections of these Terms that by their nature should survive termination (including but not limited to intellectual property rights, disclaimers, limitations of liability, indemnification, and governing law) will survive termination.
